Conditions / Refusal Reasons
The application site comprises a substantial area of land within the main built up area of Henley-on-Thames. Whilst the principle of residential development on the site is broadly acceptable, the proposed development, due to the size, height, scale, siting, design, bulk and massing of the development would result in an overdevelopment of the site, which would fail to reinforce local distinctiveness and would detract from the character and appearance of the site and surrounding area. Furthermore, the site is located immediately adjacent to the Reading Road Conservation Area, and the proposed development would fail to conserve or enhance the character and appearance of the conservation area and its setting. As such the proposal is contrary to Policies G2, G6, C1, CON7, D1 and H4 of the South Oxfordshire Local Plan 2011 and guidance contained within PPS1: Delivering Sustainable Development, PPS3: Housing, and PPG15: Planning and the Historic Environment.

The proposed care home, due to its siting, size, height, design, bulk and massing would have an overbearing impact upon and cause overlooking to the residential development approved under planning permission P06/E01302 on land to the rear of 173 Reading Road. This would be to the detriment of the residential amenity of the future occupiers of this development. As a result the proposal would fail to protect the amenity of neighbouring occupiers and therefore would fail to accord with Policies D4 and H4 of the South Oxfordshire Local Plan 2011 and guidance contained within PPS1: Delivering Sustainable Development, and PPS3: Housing.

The development fails to provide an appropriate scheme of works or on and off-site mitigation measures to accommodate the impact of the development on local infrastructure, services, or amenities. The proposal is therefore contrary to government advice, and Policy D11 of the South Oxfordshire Local Plan 2011. Furthermore, in the absence of the completion of a Section 106 Planning Obligation, the proposal has failed to provide for affordable housing provision in accordance with Policies D11 and H9 of the South Oxfordshire Local Plan 2011 and guidance contained within PPS3: Housing.
