Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G2, G6 and H4 of the South Oxfordshire Local Plan.
That prior to the first occupation of the new dwelling, the parking and manoeuvring areas shall be provided in accordance with the details shown on drawing reference 109.A1.102 and shall be constructed, laid out, surfaced [bound material], drained and completed and shall be retained unobstructed except for the parking and manoeuvring of vehicles at all times.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy D2 of the South Oxfordshire Local Plan.
That prior to the commencement of the development hereby approved, the parking and manoeuvring areas for the occupiers of number 220 Greys Road shall be provided in accordance with the plan submitted under planning application reference P05/E0388 [636.3.A] and shall be constructed, laid out, surfaced [bound material], drained and completed and shall be retained unobstructed except for the parking and manoeuvring of vehicles at all times.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy D2 of the South Oxfordshire Local Plan.
That except insofar as may be otherwise agreed by the Local Planning Authority, all trees, shrubs and hedges on the land be preserved and properly maintained and that in the event of any of the trees dying or being seriously damaged or destroyed, a new tree or equivalent number of trees, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To safeguard trees which are visually important in accordance with Policies G2 and H4 of the South Oxfordshire Local Plan.
That no development shall be carried out on the site unless an application for planning permission in that behalf is first submitted to and approved by the Local Planning Authority, and this condition shall apply notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995.
Reason: To secure the proper planning of the locality in accordance with Policies G2 and H4 of the South Oxfordshire Local Plan.
That no development shall take place until the pollarded lime tree outside the application site area has been protected in accordance with the requirements of BS 5837/2005 and such tree protection measures shall be retained until the completion of the development.
Reason: To safeguard trees which are visually important in accordance with Policy C9 of the South Oxfordshire Local Plan.
That the three first floor bathroom windows in the side elevations shall be obscure glazed and thereafter so retained.
Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 of the South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed in the rear or side elevations of the new dwelling other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 of the South Oxfordshire Local Plan.
