The application is located on the edge of but within a designated conservation area. The proposed development, due to its size, height, design, and siting, would be a prominent structure in the street scene and when viewed in context with the surrounding built form within the conservation area, the development would fail to respect the character and appearance of the conservation area. As such the development would be contrary to Policy CON7 of the South Oxfordshire Local Plan 2011 and guidance contained within Planning Policy Guidance Note 15: Planning and the Historic Environment, which seek to ensure that development does not cause harm to the character or appearance of a conservation area. Furthermore the proposal would be contrary to Policies G2, G6 and D1 of the South Oxfordshire Local Plan 2011 and guidance contained within the South Oxfordshire Design Guide 2000 and Planning Policy Statement 1: Delivering Sustainable Development, which seek to ensure that all development is of a high quality design in keeping with the character and appearance of the surrounding area.
The proposed building would be sited alongside the south western boundary of the site with the adjoining property, 1 Hamilton Avenue. The proposal due to its siting, size and height would be unduly overbearing to the neighbouring property to the detriment of the amenity of the neighbouring occupiers and as such the proposal would conflict with Policy H13 of the South Oxfordshire Local Plan 2011 and the South Oxfordshire Design Guide 2000.
