Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse. Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.

That samples of the materials to be used for the external walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before any development commences. Reason: To ensure that the details of the development are satisfactory and in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That no development shall take place until written approval has been given by the Local Planning Authority to a sample panel of all external walling materials to be used in the development. The sample panel shall be erected on the site of the development and retained until development is completed, and the panel shall thereafter be removed from the site. Reason: To ensure that the details of the development are satisfactory and in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That the walls of the dwellinghouse and garage shall be constructed using a lime based mortar mix. Reason: To ensure that the details of the development are satisfactory and in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That notwithstanding the provisions of Article 3 of, and Class A of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no additional windows to those shown on the submitted plan shall be constructed on the walls of the side of the north elevation and side of the south elevation unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the development is not unneighbourly and in accordance with Policy D4 of the South Oxfordshire Local Plan 2011.

That notwithstanding the provisions of Article 3 of, and Classes A and B of Part 1 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order), no extensions (Class A) and no additions or alterations to roofs of the dwellinghouse and garage (Class B) shall be carried out unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof. Reason: To ensure that the development is not unneighbourly and to safeguard the setting of the adjacent Grade II listed building and in accordance with Policies D4 and CON5 of the South Oxfordshire Local Plan 2011.

That development shall not begin until a detailed specification of the timber windows and external doors has been submitted to and approved in writing by the Local Planning Authority. Reason: To ensure that the details of the development are satisfactory and in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That a scheme for the landscaping of the site, including the planting of live trees and shrubs and the provision of boundary fencing and screen walling, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority. Reason: To help to assimilate the development into its surroundings and in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation. Reason: To help to assimilate the development into its surroundings and in accordance with Policy D1 of the South Oxfordshire Local Plan 2011.

That before the commencement of any site works or operations relating to the development hereby permitted the following details shall be submitted to the Local Planning Authority for approval: (i) A specification for the pruning of, or tree surgery to, trees to be retained in order to prevent accidental damage by construction activities. (ii) The specification of the location, materials and means of construction of temporary protective fencing and/or ground protection in the vicinity of trees to be retained, in accordance with the recommendations of BS 5837 (2005) 'Trees in Relation to Construction', and details of the timing and duration of its erection and where there is encroachment within the protected zones works shall be carried out using the no dig method of construction. Reason: To safeguard trees and hedges which are visually important in accordance with Policy C9 of the South Oxfordshire Local Plan 2011.

That existing ground levels on the site shall not be raised. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity and in accordance with Policy EP5 of the South Oxfordshire Local Plan 2011.

That no spoil or materials shall be deposited or stored on that part of the site lying within the area of land liable to flood as shown on maps held by the Environment Agency. Reason: To prevent the increased risk of flooding due to impedance of flood flows and reduction of flood storage capacity and in accordance with Policy EP5 of the South Oxfordshire Local Plan 2011.

That walls and fencing erected within or on the boundaries of the site shall be designed and constructed to be permeable to flood water. Reason: To prevent obstruction to the flow and storage of flood water with a consequent increased risk of flooding and in accordance with Policy EP5 of the South Oxfordshire Local Plan 2011.

That the garage building shall be used only for purposes ancillary and incidental to the occupation of the dwellinghouse as a single dwellinghouse and for no other purposes whatsoever. Reason: As the separate occupation of the building would represent an undesirable subdivision of the property and result in inadequate standards of amenity and privacy and in accordance with Policy H11 of the South Oxfordshire Local Plan 2011.

That no development shall take place within the application area until the applicant, or their agents or successors in title, has secured the implementation of a staged programme of archaeological mitigation measures in accordance with a written scheme of investigation which shall first have been submitted to and approved by the Local Planning Authority. The programme of work shall include all processing, research and analysis necessary to produce an accessible and useable archive and a full report for publication. The work shall be carried out by a professional archaeological organisation acceptable to the Local Planning Authority. Reason: To ensure the identification and preservation of features of archaeological importance and in accordance with Policy CON13 of the South Oxfordshire Local Plan 2011.
