Description
Demolition of existing farm buildings and erection of 17 new residential units involving demolition of 75 Papist Way to provide access (As amended by drawing nos. 1010-1a, 2a, 3b, 6, 7, 8, & 9 accompanying Agent's letter dated 23 February 2005).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That samples of all materials to be used in the external construction and finishes of the development hereby permitted shall be submitted to and approved in writing by the Local Planning Authority before the development is commenced.
Reason: To safeguard the character of the area in accordance with Policy H4 of the adopted South Oxfordshire Local Plan.
That no development shall commence until all existing buildings within the site have been demolished and the materials therefrom removed from the land.
Reason: To safeguard the character of the area in accordance with Policy H4 of the adopted South Oxfordshire Local Plan.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling to all boundaries and along the line of the new access road shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in accordance with Policy G9 of the adopted South Oxfordshire Local Plan.
That, prior to the commencement of development, full details of the existing ground levels on the site and the proposed slab level of the new dwellings shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the works shall be carried out in accordance with the approved plans.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G8 and H4 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the deposited plan reference 1010-01A and the Oxfordshire County Council's specification for the construction of estate streets and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification and deposited plan.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That the internal radii to the corner with the easement strip (west of unit 8) shall be six metres.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That no dwelling shall be occupied until the whole of that portion of the roads referred to in Condition No. 6 which is to serve such dwelling, except for the final surfacing thereof, and all surface water drainage works have been laid out, constructed and completed in accordance with the Oxfordshire County Council's specification for the construction of works for housing development.
Reason: In the interests of highway safety and to provide reasonable living conditions during construction in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That the parking provision shall be as shown on the deposited drawing, reference 1010-1A all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates the means of access between the land and the highway shall be formed, laid out and constructed in such position and with such vision splays as shall be approved by, and in all respects to the satisfaction of, the Local Planning Authority.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning General Development Order 1995 (or any order revoking and re-enacting that Order) the garage accommodation, where provided, shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
No development shall take place until the LPA are satisfied that contamination has been sufficiently investigated and any remedial action approved. The site shall then not be occupied until any agreed action is implemented and approved by the LPA.
i. The following measures (a-d) shall be undertaken to investigate and remediate any contamination on the site prior to commencement of the development:
a) A desk study shall be submitted to and approved in writing by the LPA. This study shall be conducted fully in line with the approach indicated in BS 10175: 2001 (Investigation of potentially contaminated sites - code of practice). The study shall include the identification of all previous site uses, potential contaminants that might reasonably be expected given those uses and other relevant information. If contamination is suspected at the site the information obtained must then be used to formulate an initial conceptual model for the site including all potential contaminant sources, pathways and receptors.
b) Where contamination is identified as having the potential to be present in a) above, proposals for a site investigation to characterise the site must be submitted to and approved in writing by the LPA. This proposal shall be designed having regard to the approved desk study and BS 10175. It should be clear about what information it seeks to obtain and how this will refine the initial conceptual model for the site.
c) The approved site investigation referred to on b) above shall be fully implemented and a report submitted to the LPA for written approval. The report shall be in line with BS 10175 and detail the works undertaken to characterise the site and contain a refined conceptual model in the light of the results of the investigation. N.B. If the LPA is not satisfied that the site has been adequately characterised after the first stage of investigation, further works will be required to clarify any remaining uncertainties.
d) Where unacceptable levels of contamination are identified, a remediation scheme shall be submitted to and approved in writing by the LPA. The scheme shall incorporate details of the procedures and documentation employed to validate the remediation measures identified in c) above.
ii. Prior to occupation of the site, the approved remediation and validation schemes in d) above shall be fully implemented and a report submitted and approved in writing by the LPA.
Reason: To ensure that any ground and water contamination is identified and adequately addressed to ensure the safety of the development, the environment and the public and ensure that the site is suitable for the proposed use in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That details of the foul and surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing.
Reason: In the interests of public health in accordance with Policy G7 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of development on the site a study shall be carried out to determine whether the local sewerage system has sufficient capacity to accommodate the proposed development. If improvements to the system are considered necessary then the study shall determine the magnitude of any new additional capacity required in the system and a suitable connection point if required. The study shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of development on the site.
Reason: To ensure that the infrastructure is sufficient to accommodate the proposed development in accordance with Policies G1 and G6 of the adopted South Oxfordshire Local Plan.
That clean, uncontaminated rock, subsoil, brick rubble, crushed concrete and ceramic only shall be permitted as infill material.
Reason: To prevent contamination of ground water in accordance with Policy G7 of the adopted South Oxfordshire Local Plan
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed in the north eastern side elevation of the dwelling on plot 1, the north side elevations of the dwellings on Plots 2 and 3 and the north side elevation of the dwelling on Plot 10 (these are the elevations facing 15, 13, 11 Kennedy Crescent and 1 and 3 Queens Road respectively) other than those expressly authorised by this permission.
Reason: To ensure that the development is not unneighbourly in accordance with Policy H4 of the Adopted South Oxfordshire Local Plan.
