Conditions / Refusal Reasons
That in the opinion of the Local Planning Authority the proposed development would take place within the root protection zone and would therefore threaten the health and longevity of trees on the site which are the subject of a tree preservation order. Further, the erection of a summerhouse in close proximity to the trees could result in pressure for works to be carried out to the trees in the future in order to improve light reaching the structure. It is considered that the loss of the trees would be detrimental to the character and appearance of the area. As such the development would be contrary to the provisions of the adopted South Oxfordshire Local Plan, particularly policies G1, C2, and C17 and the South Oxfordshire Local Plan 2011 (Second Deposit) Draft, particularly policies G2, C2, H13 and C10.
