Conditions / Refusal Reasons
That having regard to its excessive size and massing, to its inappropriate details of design and its location set back on the plot, the proposed development would result in an overdevelopment of the plot and a form of development that would be out of keeping with surrounding development. Therefore the erection of a house on this site would detract from the character and appearance of the area and would be contrary to the provisions of the adopted South Oxfordshire Local Plan, particularly policies G1, G8, C3, H4 and H5 and the South Oxfordshire Local Plan 2011 (Second Deposit) Draft, particularly policies G2, G6, H4 and H5.
That having regard to its position on the site, extending to the rear of both Gypsy Cottage and Brook Cottage, the proposed house would be overbearing, oppressive and would overshadow and overlook adjoining residential properties to the detriment of the residential amenities of the occupiers of those dwellings. In this respect the development would be contrary to the provisions of the adopted South Oxfordshire Local Plan, particularly policies H4, H5 and H11 and the South Oxfordshire Local Plan 2011 (Second Deposit) Draft particularly policies D3, D4, H4 and H5.
That the development would fail to provide adequate parking for the new dwelling and Gypsy Cottage and would therefore be likely to result in parking on the public highway causing inconvenience to other users of the public highway. Therefore the development would be contrary to policy G10 of the adopted South Oxfordshire Local Plan and T1 of the South Oxfordshire Local Plan 2011 (Second Deposit) Draft.
That the site lies within an area liable to flooding and no Flood Risk Assessment accompanies the application to demonstrate that the development can be accommodated without adding to the risk of flooding in the area. Therefore the development is contrary to the provisions of the adopted South Oxfordshire Local Plan, particularly policy G16 and the South Oxfordshire Local Plan 2011 (Second Deposit) Draft particularly policy EP5.
