Description
Replacement of existing outbuilding with new outbuilding incorporating garaging, domestic storage and ancillary residential accommodation. Construction of swimming pool and tennis court. (As amplified by by drawing accompanying letter from Agent received 19 May 2005).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of three years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990 as amended by section 51 of the Planning and Compulsory Purchase Act 2004.
That samples of the materials to be used for the external walls and roof shall be submitted to and approved in writing by the Local Planning Authority before any development commences.
Reason: To ensure that the details of the development are satisfactory in accordance with Policy G6 of the adopted South Oxfordshire Local Plan.
That the additional living accommodation hereby permitted shall be occupied and used only in connection with and ancillary to the occupation and use of the existing property High Acres only as a single dwellinghouse, as specified in the application, and shall not be occupied or used separately therefrom.
Reason: As the separate occupation of the accommodation would be contrary to the planning policy H6 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General permitted Development) Order 1995, or any modifications thereof, no additional windows or other openings shall be inserted in the outbuilding without the prior grant of planning permission from the local planning authority.
Reason: To ensure that the details of the development are satisfactory in accordance with Policy G6 of the adopted South Oxfordshire Local Plan.
That no floodlighting shall be erected on the site without the prior grant of the planning permission from the Local Planning Authority.
Reason: To protect the amenity of the area in accordance with Policy C2 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of the development, a detailed arboricultural method statement, which shall include details of tree protection in accordance with the recommendations given in BS 5837 shall be submitted to and agreed in writing by the Local Planning Authority. Thereafter the development shall be carried out in accordance with the approved method statement.
Reason: To ensure that the important trees are retained in accordance with Policies G6, C2 and C9 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of the development, a landscaping scheme showing the provision of planting to the rear of the proposed outbuilding shall be submitted to and approved by the Local Planning Authority. The planting scheme shall be implemented within the first planting season following the first use of the outbuilding, and shall be retained and maintained. In the event of any plant dying, it shall be replaced with a plant of a similar species within the following planting season.
Reason: to help assmilate the development into its surroundings in accordance with Policies G6 and C2 of the adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking or re-enacting that Order) the garage accommodation shall be retained as such and shall not be adapted for living purposes without the prior grant of planning permission by the Local Planning Authority on a formal application in respect thereof.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policies G2 and G6 of the adopted South Oxfordshire Local Plan.
