Five new houses and new access. (As amended by drawing No. 04/166/600 Rev B accompanying letter from Agent dated 6 January 2005 and drawing no.04/166/700 Rev BB accompanying letter from Agent dated 9 February 2005 and as amended by Drawing No. 04/166/700 Rev C accompanying Agent's letter dated 18 February 2005).
Conditions / Refusal Reasons
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 5 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help assimilate the development into its surroundings in accordance with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.
That all planting, seeding or turfing comprised in the approved scheme of landscaping shall be carried out in the first planting and seeding seasons following the occupation of the buildings or the completion of the development, whichever is the sooner; and any trees or plants which within a period of 5 years from the completion of the development die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar size and species, unless the Local Planning Authority gives written consent to any variation.
Reason: To help assimilate the development into its surroundings in accordance with Policies G1 and G9 of the adopted South Oxfordshire Local Plan.
That no development shall take place until a professionally competent archaeological organisation, as approved in writing by the Local Planning Authority, has been commissioned to carry out a full watching brief during the period of construction works. The watching brief shall preserve by record any archaeological features which may arise in the course of works and shall include limited archaeological excavation where necessary and the retrieval of artefactual evidence.
Reason: To safeguard the recording and inspection of matters of archaeological importance on this site in accordance with Policy CON7 of the adopted South Oxfordshire Local Plan.
Before the commencement of any site works or operations relating to the development hereby permitted, an arboricultural method statement to ensure the satisfactory protection of retained trees during the construction period shall be submitted to the Local Planning Authority for approval. Written approval must be obtained prior to commencement of any site works including demolition. The matters to be encompassed within the arboricultural method statement shall include the following:-
(i) A specification for the pruning of, or tree surgery to, trees to be retained in order to prevent accidental damage by construction activities;
(ii) The specification of the location, materials and means of construction of temporary protective fencing and/or ground protection in the vicinity of trees to be retained, in accordance with the recommendations of BS 5837 (1991) "Trees in relation to construction", and details of the timing and duration of its erection;
(iii) The definition of areas for the storage of stockpiling of materials, temporary on-site parking, site offices and huts, mixing of cement or concrete, and fuel storage;
(iv) The means of demolition of any existing site structures, and of the reinstatement of the area currently occupied thereby;
(v) The specification of the routing and mean of installation of drainage or any underground services in the vicinity of retained trees;
(vi) The details and method of construction of any other structures such as boundary walls in the vicinity of retained trees and how these relate to existing ground levels;
(vii) The details of the materials and method of construction of the roadway, which is to be of a 'no dig' construction method in accordance with the principles of Arboricultural Practice Note 1 "Driveways close to trees", and in accordance with current industry best practice; and as appropriate for the type of roadway required in relation to its usage.
(viii) Provision for the supervision of ANY works within the root protection areas of trees to be retained, and for the monitoring of continuing compliance with the protective measures specified, by an appropriately qualified arboricultural consultant, to be appointed at the developer's expense and notified to the Local Planning Authority, prior to the commencement of development; and provision for the regular reporting of continued compliance or any departure therefrom to the Local Planning Authority.
Reason: To safeguard the future health and well being of established trees on the site in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.
That the access construction at the entrance to the site shall be in accordance with details to be submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard trees and hedges which are visually important in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the means of access between the land and the highway shall be formed, laid out and constructed strictly in accordance with the specification of the means of access attached hereto, and all ancillary works therein specified shall be undertaken strictly in accordance with the said specification.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of the adopted South Oxfordshire Local Plan.
That the parking provision shall be as shown on the deposited drawing, reference 201 all constructed, surfaced and laid out, retained and maintained to the satisfaction of the Local Planning Authority.
Reason: To comply with the Local Planning Authority's vehicle parking standards and to protect local amenities in accordance with Policy G11 of the adopted South Oxfordshire Local Plan.
That no other development shall be carried out on the site unless an application for planning permission in that behalf is first submitted to and approved by the Local Planning Authority, and this condition shall apply notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995.
Reason: To secure the proper planning of the locality in accordance with Policy H5 of the adopted South Oxfordshire Local Plan.
That the rooflights in the garage block shall be of a conservation type and so retained.
Reason: To ensure that the details of the development are satisfactory in accordance with Policies G1, G8 and CON10 of the adopted South Oxfordshire Local Plan.
That all works that take place within the tree protection zone shall be fully supervised by a qualified aboriculturalist and that all such construction shall take place onto existing ground level with no excavation.
Reason: To safeguard the future health and well being of established trees on the site in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.
That a method statement and drawings showing how the proposed paving will be constructed within the tree protection zone without damage to the trees shall be submitted to and approved in writing by the Local Planning Authority.
Reason: To safegurad trees and hedges which are visually important in accordance with Policies G8 and C16 of the adopted South Oxfordshire Local Plan.
