Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the colour of the building hereby approved shall be agreed in writing by the Local Planning Authority prior to the commencement of development.
Reason: In order to safeguard the character of the area in accordance with
Policy G1 of the adopted South Oxfordshire Local Plan.
That the hours of operation of the nursery shall be as specified in the application, 7 am - 7 pm Monday to Friday, and shall not be changed without express planning permission from the Local Planning Authority.
Reason: In order to safeguard the local amenity in accordance with Policy G1
of the adopted South Oxfordshire Local Plan.
That four additional car parking spaces shall be formed and all existing and proposed parking spaces shall be retained and maintained for use in connection with the nursery school building, in accordance with a detailed layout plan to be submitted to and approved by the Local Planning Authority prior to the commencement of development.
Reason: To comply with the Local Planning Authority's vehicle parking
standards and to protect local amenities in accordance with
Policy G11 of the adopted South Oxfordshire Local Plan.
That in the event of the day nursery use ceasing the building hereby permitted shall be removed and all resulting materials removed from the site within nine months of the date of its last use.
Reason: Having regard to the appearance of the modular building it is not
considered appropriate for long term retention particularly in the
absence of a particular need in accordance with Policies G1, G8
and CF1 of the adopted South Oxfordshire Local Plan.
