Description
Demolition of buildings and erection of a new retail store (class A1) including ancillary A3 floorspace, service yard, car parking, new access road and associated landscaping (as amended by drawings listed in letter from agent dated 27th February 2003).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That details and samples of the materials to be used for all new walls and roofs shall be submitted to and approved in writing by the Local Planning Authority before development commences.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That all new brickwork shall be laid in Flemish bond.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That detailed specifications of the designs, materials and external finishes of all wall plinths, copings and coursing; windows, including glazing; external doors; rainwater goods; eaves; gates (including gates to The Mint) and railings; and the internal staircase adjacent to High Street shall be submitted to and approved by the Local Planning Authority before development commences.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That the glazing approved in accordance with Condition 4 shall not be changed unless otherwise approved in writing by the Local Planning Authority.

accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That no goods, furniture or other impediment to view up to 2 metres high shall be placed within 1 metre of windows W9. W12, W13 and W15 on High Street except as approved in writing by the Local Planning Authority.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That the public store entrance on High Street shall be kept open for public use at all times that the building is open to the public.

accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That a scheme for the soft landscaping of the site, including the planting of live trees and shrubs, shall be submitted to and approved in writing by the Local Planning Authority before development commences. The scheme which shall include tree pit/trench designs and details of underground service runs shall be implemented as approved no later than the first planting season following opening of the store for trade and shall be maintained in accordance with the approved scheme for a period of 5 years thereafter. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within the maintenance period, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, shall be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That those trees shown to be retained shall be retained and shall be protected during the course of development in accordance with BS5837:1991 'Trees in Relation to Construction' and details which shall have been submitted to and approved in writing by the Local Planning Authority before development commences.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That a scheme of hard landscaping including details of all ground surface treatments, any changes in ground levels and details of all cycle racks, trolley bays, parking ticket machines and the glass recycling bank shall be submitted to and approved in writing by the Local Planning Authority. The approved scheme shall be implemented prior to first opening of the store to the public.
Reason: To safeguard the character of the Wallingford Conservation Area in
accordance with Policy Con 8 of the adopted South Oxfordshire
Local Plan.
That external lighting within the site shall be provided before first opening of the store to the public in accordance with details which shall first have been submitted to and approved in writing by the Local Planning Authority. Such details shall include luminaire types, numbers, distribution, mounting heights, lamp type (e.g. SON/SOX), light output ratios and horizontal illuminance and hours of use. No further lighting shall be installed without the approval in writing of the Local Planning Authority.
Reason: To provide for the needs of visitors, to safeguard the amenity of local
residents and to safeguard the character of the Wallingford
Conservation Area in accordance with Policies G10, G11, G7 and
Con 8 of the adopted South Oxfordshire Local Plan.
That provision for servicing and car parking shall be made in accordance with drawing PL1006 Rev H before first occupation of the store.
Reason: In the interests of highway safety and convenience in accordance with
Policy G11 of the adopted South Oxfordshire Local Plan.
That the store shall not be occupied until the means of access between the land and the highway has been formed, laid out and constructed strictly in accordance with the deposited plan reference PL1006 Rev H and the attached specification and all ancillary works therein specified have been undertaken strictly in accordance with the said specification and deposited plan.
Reason: In the interests of highway safety and convenience in accordance
with Policy G10 of the adopted South Oxfordshire Local Plan.
That the store shall not be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works have been laid out, constructed and completed in accordance with a specification to be submitted to and approved by the Local Planning Authority.
Reason: In the interests of highway safety and convenience in accordance with
Policy G10 of the adopted South Oxfordshire Local Plan.
That surface water drainage works shall be carried out before first occupation of the store in accordance with details submitted to and approved in writing by the Local Planning Authority prior to the development commencing.
Reason: In the interests of public health in accordance with Policy G17 of the
adopted South Oxfordshire Local Plan.
That a scheme for the disposal of foul sewage shall be carried out before first occupation of the store in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health and to avoid pollution in accordance
with Policy G7 of the adopted South Oxfordshire Local Plan.
That no development apart from demolition works (unless separately approved in writing by the Local Planning Authority) shall take place within the application area until the applicant, or their agents or successors in title has:
(i) caused to be implemented a phased programme of archaeological exploration (evaluation) in accordance with a first written scheme of investigation which has been submitted to and approved by the Local Planning Authority; and next
(ii) submitted the results of the archaeological evaluation to the Local Planning Authority; and next
(iii) secured the implementation of a phased programme of archaeological mitigation measures that shall preserve significant archaeological artefacts, features and deposits in a sustainable manner by foundation design and/or by record through an appropriate archaeological excavation and recording action, in accordance with a second written scheme of investigation that has been submitted and approved by the Local Planning Authority. This written scheme of investigation shall include a formal commitment to implement a programme of archaeological post-excavation work that shall include all processing, research and analysis necessary to produce an accessible and usable archive and a full academic report for publication in accordance with a written Post-Excavation Assessment review that has been submitted to and approved by the Local Planning Authority.
(iv) ensured that the whole of the staged programme of archaeological work outlined in this condition shall be carried out by a professional archaeological organisation acceptable to the Local Planning Authority.
Reason: To ensure the implementation of an appropriate programme of
mitigation measures that will identify, preserve in situ or by record,
archaeological remains affected by the development in accordance
with Policy Con 18 of the adopted South Oxfordshire Local Plan.
That a scheme for the further investigation and remediation of contamination shall take place prior to the erection of new buildings on the site in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health and to avoid pollution in accordance
with Policy G7 of the adopted South Oxfordshire Local Plan.
That no service deliveries and collections shall take place except between the hours of 7.00am and 11.00pm.
Reason: To safeguard the amenities enjoyed by local residents in accordance
with Policy G7 of the adopted South Oxfordshire Local Plan.
That the store shall not be open to the public except between the hours of 7.00am and 11.00pm.
Reason: To safeguard the amenities enjoyed by local residents in accordance
with Policy G7 of the adopted South Oxfordshire Local Plan.
That the level of noise from external electrical and mechanical plant on the site shall not exceed 30 dB between 7.00 am and 11.00 pm and 20 dB at any other time as measured at the facade of the nearest noise sensitive premises (expressed as LAeq over a representative time period).
Reason: To safeguard the amenities enjoyed by local residents in accordance
with Policy G7 of the adopted South Oxfordshire Local Plan.
That a 3.5 metre high acoustic barrier shall be erected between the access road and The Mint as shown in Figure 10.0/2 of the Noise and Vibration Technical Appendix before first opening of the store to the public in accordance with detailed specifications submitted to and approved in writing by the Local Planning Authority.
Reason: To safeguard the amenities enjoyed by local residents in accordance
with Policy G7 of the adopted South Oxfordshire Local Plan.
That a scheme for closed circuit television monitoring of the site, including camera installation and management, shall be carried out prior to opening of the store to the public in accordance with details submitted to and approved in writing by the Local Planning Authority.
Reason: To promote security in accordance with Policy G14 of the adopted
South Oxfordshire Local Plan.
The development shall be carried out in accordance with a scheme for the phasing of the development which shall have been approved in writing by the Local Planning Authority. The scheme shall allow for continued use of a minimum of 50 car parking spaces and access thereto, of public toilets, for access to adjacent properties and for pedestrian access to Market Place and Church Lane during development operations.
Reason: To safeguard the viability and vitability of the town centre and the
amenity enjoyed by occupiers of adjacent properties in accordance
with Policies G11 and S1 of the adopted South Oxfordshire Local
Plan.
That a Green Travel Plan shall be implemented and maintained in accordance with details submitted to and approved in writing by the Local Planning Authority before opening of the store to the public.
Reason: To maximise use of sustainable means of transport in accordance
with Policy G2 of the adopted South Oxfordshire Local Plan.
