Residential development comprising 7 no. 3-bed houses, 2 no. 2-bed flats and 2 no. 1-bed flats. Access (as amended by drawing nos.2728B, 2729B and 2730A accompanying agent's letter dated 7 Sepember 2001).
Conditions / Refusal Reasons
That the development must be begun not later than the expiration of five years beginning with the date of this permission and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning
Act 1990.
That the external walls and roofs of the buildings be constructed and finished in accordance with a schedule of materials and finishes which shall first have been submitted to and approved in writing by the Local Planning Authority before the development commences.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8, CON10 and H5 of the Council's
adopted South Oxfordshire Local Plan.
That development shall not begin until a detailed specification of all windows, external doors and rainwater goods has been submitted to and approved in writing by the Local Planning Authority.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8, CON10 and H5 of the Council's adopted
South Oxfordshire Local Plan
That prior to the commencement of the development detailed drawings at a scale of not less than 1:20 illustrating the construction and design of the dormer windows shall be submitted to and approved in writing by the Local Planning Authority. Thereafter the dormer shall be constructed and in accordance with the approved details.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8, CON10 and H5 of the Council's
adopted South Oxfordshire Local Plan.
That the garage doors shall be constructed in dark stained timber boarding and shall thereafter be retained as such.
Reason: To ensure that the details of the development are satisfactory in
accordance with Policies G8, CON10 and H5 of the Council's adopted
South Oxfordshire Local Plan.
That a scheme for the landscaping of the site, including the planting of live trees and shrubs, the treatment of the access road and hardstandings, and the provision of boundary fencing and screen walling shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of the development hereby permitted. The scheme shall be implemented as approved within 12 months of the commencement of the approved development and thereafter be maintained in accordance with the approved scheme to the complete satisfaction of the Local Planning Authority. In the event of any of the trees or shrubs so planted dying or being seriously damaged or destroyed within 3 years of the completion of the development, a new tree or shrub or equivalent number of trees or shrubs, as the case may be, of a species first approved by the Local Planning Authority, be planted and properly maintained in a position or positions first approved by the Local Planning Authority.
Reason: To help to assimilate the development into its surroundings in
accordance with Policies G8, G9, CON10, H5 and H11 of the
Council's adopted South Oxfordshire Local Plan.
That the existing trees, shrubs and hedges on the land shall be protected whilst development operations are in progress, in accordance with a scheme to be first agreed in writing with the Local Planning Authority and to be implemented prior to the commencement of the development.
Reason: To protect the character and appearance of the area in accordance
with Policies G8, CON10 and H5 of the Council's adopted South
Oxfordshire Local Plan.
That the dwellings and flats shall not be occupied until the parking provision has been constructed, surfaced and laid out, as shown on drawing no. 2728 Rev B; and such parking provision shall be permanently retained thereafter.
Reason: To ensure satisfactory provision is made for the parking of vehicles in
accordance with Policy G11 of the Council's adopted South
Oxfordshire Local Plan.
That notwithstanding the provisions of Article 3 of, and Class 1 of Schedule 1 to the Town and Country Planning General Development Order 1995 (or any order revoking and re-enacting that Order), no development falling within Classes A, C, D or E shall be undertaken on the site unless planning permission has first been granted by the Local Planning Authority on a formal application in respect thereof.
Reason: To protect the amenity of neighbouring properties in the terrace, the
character of the development and to ensure adequate amenity
space is retained in accordance with Policies H5 and H11 of the
Council's adopted South Oxfordshire Local Plan.
That prior to the first occupation of plot one and plot seven the front (north) facing dormer windows at second floor level shall be glazed in obscure glass and shall thereafter be permanently retained as such.
Reason: In order to protect the privacy of the occupiers of the Old School
House and 27 High Street, Nettlebed in accordance with Policies H5
and H11 of the Council's adopted South Oxfordshire Local Plan.
That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order) no windows shall be constructed in the flank elevations of the terrace and north elevation of the block of flats other than those expressly authorised by this permission.
Reason: In order to protect the character and appearance of the development
and the privacy of neighbours in accordance with Policies H5 and H11
of the Council's adopted South Oxfordshire Local Plan.
That a full archaeological watching brief shall be carried out during the period of construction works in accordance with details and by a professionally competent archaeological organisation which shall have been submitted to and approved in writing by the Local Planning Authority before development commences. The brief shall include the recording of any archaeological features revealed, limited archaeological excavation and the retrieval of artefactual evidence.
Reason: As the site is likely to be of archaeological importance in
accordance with Policy CON 18 of the Council's adopted South
Oxfordshire Local Plan.
That details of the surfacing for the footpaths shall be submitted to and approved in writing by the Local Planning Authority prior to the commencement of any development. Thereafter the footpaths shall be constructed and finished in accordance with the approved details prior to the first occupation of any of the residential units.
Reason: To secure appropriate pedestrian access and a satisfactory
appearance in accordance with Policies G8, G11, H11, CON10
and H5 of the Council's adopted South Oxfordshire Local Plan
That surface water shall not be disposed of other than in accordance with a detailed surface water drainage scheme which shall first have been submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health in accordance with Policy G17 of the
Council's adopted South Oxfordshire Local Plan.
That prior to the commencement of any other development to which this permission relates, the junction of the estate road shall be laid out and constructed in the position and with the vision splays shown on the deposited plan reference 2728 Rev B received on 10 September 2001.
Reason: In the interests of highway safety and convenience in accordance with
Policy G10 of Council's adopted South Oxfordshire Local Plan.
That no dwelling shall be occupied until the whole of the roads and footpaths shown on the layout plan accompanying the application, and all surface water drainage works, have been laid out and constructed in accordance with the Oxfordshire County Council Design Guide for Residential Roads and the specification for the construction of works for housing development.
Reason: In the interests of highway safety and convenience in accordance with
Policy G10 of the Council's adopted South Oxfordshire Local Plan.
That no dwelling to be constructed pursuant to this permission shall be occupied until the new school, community hall and all weather playing surface has been constructed and completed in accordance with the plans approved by Oxfordshire County Council pursuant to planning application S.29/03 (As an amendment to application permission No. S.05/01) unless otherwise agreed in writing by the Local Planning Authority.
Reason: The District Council has made an exception to its housing policies
in the light of the benefits associated with the provision of a new
school, all weather playing surface and community hall in accordance
with Policies CF1 and H5 of the Council's adopted South Oxfordshire
Local Plan.
