Conditions / Refusal Reasons
That notwithstanding any indications as to these matters which have been given in this application, no development shall be started until full details of the following have been submitted to, and approved in writing by, the Local Planning Authority:-
the siting, layout and number of buildings; the plans and elevations of all buildings; a scheme for the landscaping of the site including the planting of live trees, the treatment of forecourts and driveways, and the provision of boundary fencing and screening walling.
Reason: As the application is in outline only and not accompanied by detailed plans in
accordance with Policy G1 of the adopted South Oxfordshire Local Plan.
That application for approval of the reserved matters referred to in Condition 1 above shall be made to the Local Planning Authority not later than three years from the date of this permission, and if this condition is not complied with this permission shall lapse.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That the development to which this permission relates shall be begun not later than whichever is the later of the following dates; (a) the expiration of three from the date of this permission; or (b) the expiration of two from the final approval of the reserved matters, or, in the case of approval on different dates, the final approval of the last such matter to be approved.
Reason: By virtue of Sections 91 to 95 of the Town and Country Planning Act 1990.
That the reserved matters application referred to in Condition 1 above shall include the provision of a cycleway/footpath linking Hithercroft Road to Fir Tree Avenue, to be provided prior to occupation of any building.
Reason: To ensure satisfactory comprehensive development in accordance with Policy G10
of the adopted South Oxfordshire Local Plan.
That notwithstanding any indication given in the application, no development shall take place within 10m of the northern boundary of the site.
Reason: To ensure that the development is not unneighbourly in accordance with Policy
E6 of the adopted South Oxfordshire Local Plan.
That the landscaping scheme referred to in Condition 1 above shall make specific provision for the landscaping of the northern boundary of the site.
Reason: To ensure that the development is not unneighbourly in accordance with Policy
E6 of the adopted South Oxfordshire Local Plan.
That except as may be agreed in writing with the Local Planning Authority, any units with an elevation facing the northern boundary of the site shall be used for Class B1 use as defined by the Town and Country Planning (Use Classes) Order 1987.
Reason: To ensure that the development is not unneighbourly in accordance with Policy
E6 of the adopted South Oxfordshire Local Plan.
That prior to the occupation of any building on the site, roads, footpaths, turning spaces, vehicle manoeuvring areas and sufficient parking spaces to accord with the District Council's Parking Standards shall have been laid out, constructed and completed in accordance with a specification to be submitted to and approved in writing by the Local Planning Authority. The areas so completed shall thereafter be retained for the stated purpose, unless otherwise agreed in writing by the Local Planning Authority.
Reason: To comply with the Local Planning Authority's approved standards in accordance
with Policy G10 of the adopted South Oxfordshire Local Plan.
That details of surface water drainage works shall be submitted to and approved in writing by the Local Planning Authority prior to the development commencing.
Reason: In the interests of public health in accordance with Policy G17 of the adopted South
Oxfordshire Local Plan.
That development shall not begin until a scheme for the disposal of foul sewage has been submitted to and approved in writing by the Local Planning Authority.
Reason: In the interests of public health and to avoid pollution in accordance with Policy
G6 of the adopted South Oxfordshire Local Plan.
That before development commences a detailed site investigation shall be carried out to establish if the site is contaminated, to assess the degree and nature of contamination, and to determine its potential for pollution of the water environment. The method and extent of this site investigation which shall have regard to BS10175:2001 'Investigation of Potentially Contaminated Sites' shall be agreed in writing by the Local Planning Authority. A detailed remediation scheme including measures for rendering innocuous or removing contaminants from the site and for preventing pollution of groundwater and surface water including provision for monitoring, testing of any imported materials and validation procedures shall be submitted to and approved in writing by the Local Planning Authority before development commences. The scheme shall be implemented prior to the first occupation of any part of the development.
Reason: To ensure safe occupation and use of the site and to prevent pollution of the water
environment in accordance with Policy G7 of the adopted South Oxfordshire Local
Plan
That the details to be agreed in accordance with Condition 9 above shall include details of surface water control measures.
Reason: To prevent flooding of adjoining land and to avoid pollution in accordance with Policy
G17 of the adopted South Oxfordshire Local Plan.
That no development shall begin until details of the junction between the proposed service road and the highway have been approved by the Local Planning Authority. No building shall shall be occupied until the junction has been constructed in accordance with the approved details.
Reason: In the interests of highway safety and convenience in accordance with Policy G10 of
the adopted South Oxfordshire Local Plan.
